ARTICLE 5: THE USER'S RIGHTS REGARDING DATA COLLECTION AND PROCESSING

Any user concerned by the processing of their personal data may avail themselves of the following rights, pursuant to European Regulation 2016/679 and the Data Protection Act (Law 78-17 of January 6, 1978):

ARTICLE 6: CONDITIONS FOR MODIFYING THE PRIVACY POLICY

The site editor, Louis De Larrard, reserves the right to modify the present Policy at any time in order to ensure site users' compliance with current legislation.

Any modifications shall not affect purchases previously made on the site, which shall remain subject to the Policy in force at the time of purchase and as accepted by the user when validating the purchase.

Lease clauses

For reasons of document size, it is not obligatory to print the Clauses with the Lease Agreement pages. However, if you wish, you may print out the detailed Clauses and co-sign them.

1. Parties to the Lease Agreement

The Rental Contract is concluded between the Hirer (Good Motors Agency) and the Hirer. It establishes the conditions under which the Hirer may rent a vehicle from Good Motors Agency.

2. Responsibilities of Good Motors agency

Good Motors agency is committed to renting a motorcycle:

  • that complies with the law or regulations of the country (France) in which the Vehicle is registered;
  • for which the maintenance recommended by the manufacturer has been carried out and for which all safety equipment is, to the best of its knowledge, in perfect condition, in particular tires, brakes, headlights and lights, steering fork, as well as the presence of all safety equipment required in the country in which the Vehicle is registered;
  • which is insured for at least one third of the year and by any other compulsory insurance under the laws of the country in which the Vehicle is registered.
  • of which he is and remains the owner for the entire duration of the Rental or for which he has the owner's express authorization and, in all cases, which he is authorized to rent;
  • with a copy of the vehicle registration certificate;

Good Motors Agency agrees not to rent the Vehicle if it becomes aware of a technical problem affecting the safety of the Vehicle.

3. Tenant's responsibilities

The Tenant undertakes to :

  • comply with available insurance conditions:
  • No at-fault bodily injury claims with aggravating circumstances in the last 36 months and/or 2 or more at-fault property claims
  • Within Europe only
  • not to significantly exceed the mileage indicated at the time of booking on the site without notifying Good Motors agency;
  • use the Vehicle in a reasonable and responsible manner;
  • return the Vehicle in a clean condition and with the same level of fuel as at the start of the rental period;
  • do not entrust the Vehicle's handlebars to another person
  • not to abandon the Vehicle after an accident or breakdown, and to keep it under his responsibility until Good Motors agency assistance can intervene.

4. Procedure in the event of accident or theft

The Tenant shall immediately notify the police or competent authorities in the event of an accident involving persons, theft, loss, fire, damage caused by game or other damage, and obtain a report or record attesting to the conditions under which the incident occurred.

The Hirer is also obliged to inform Good Motors agency of any event affecting the Vehicle as soon as possible.

In the event of an accident with a third party, the Tenant undertakes to scrupulously follow the "Instructions for the Tenant" provided by Good Motors agency at the beginning of the rental period.

If a repair is necessary, the Renter must notify Good motors agency and obtain its authorization before undertaking the repair.

In any event, the Renter has a maximum of two working days in the event of theft or attempted theft, and five working days in the event of accident, fire or any other event from the date of the loss, to declare a loss to Good Motors Agency, by sending an e-mail to Good Motors Agency's customer service department at the following address: vroom@goodmotors.agency. After this deadline, the insurance (and the reduction of the deductible) will not cover the claim and all costs will be borne by the Tenant. Under no circumstances should the Tenant wait until the end of the rental period to report a claim.

5. Liability in the event of accident or theft

The Hirer is responsible for the Vehicle in his or her custody for the duration of the Hire as set out in the Rental Contract.

The Vehicle, as well as all accessories made available to the Renter, must be returned in the condition observed by both parties at the beginning of the rental period, and on the date and time specified in the Rental Contract.

In the event of theft, damage caused to the Vehicle or its accessories through the fault of the Renter or in the absence of fault on the part of an identified third party, or failure to return the Vehicle, the Renter is responsible for all costs incurred.

In the event of damage at the end of the rental period, the Hirer undertakes to immediately leave a security deposit with Good Motors agency. The amount of this deposit is the amount of the insurance excess in the event of a claim, i.e. between €500 and €3,000 depending on the value of the vehicle.

Photographs taken at the time of the departure and return inspections must carefully comply with the shooting instructions. Any attempt to defraud the renter will result in non-refund of the deposit and banishment from Good Motors Agency.

The Tenant and Good Motors agency also agree to the following conditions:

  • In the event of a puncture, tires are the responsibility of the Hirer. If Good Motors agency has to change two tires following a puncture, the Renter must pay for the replacement of one tire as well as 50% of the cost of a second tire. If the puncture is due to abnormal age of the tires, all costs will be borne by Good Motors agency.
  • In the event of loss or theft of the Vehicle's key during the Rental Period, the Hirer shall be liable for the cost of producing a new key for Good Motors agency, and if Good Motors agency expressly so requests, for 50% of the cost of changing the cylinder and the complete set of keys.

6. Liability for breakdowns

Good Motors agency is responsible for the maintenance of its Vehicle, and is therefore liable for mechanical and electronic breakdowns. However, ifGood Motors agency believes that the Lessee is responsible for a breakdown resulting from use of the Vehicle contrary to the terms of the Lease Agreement, Good Motors agency may commission an independent expert to attest to this. Following a joint expert appraisal, responsibility for the breakdown will be determined. If the Hirer is found to be responsible for the breakdown, he/she will be required to pay for all repairs incurred, as well as any appraisal costs incurred by the Rental Firm.

In the event of a breakdown unrelated to use of the Vehicle contrary to the terms of the Rental Contract, the Renter may interrupt the Rental Contract and be reimbursed for the unused rental time.

7. Contraventions

The Tenant who commits an offence resulting in a fine must bear the cost thereof. The Lessee who receives a fine or believes that he/she has committed an offence detected by an automatic control must notify Good Motors agency when returning the Vehicle.

The Renter is liable for a service charge of 30 Euros, in addition to the amount of the fine, for each fine incurred during the Rental Period.

8. Compensation and penalties

If the Tenant wishes to modify the duration of the Rental Contract, he/she must request an extension by e-mail (vroom@goodmotors.agency) before the end of the Rental Contract.

If the Hirer returns the Vehicle later than agreed, the Hirer will be liable for the following late payment penalties:

  • The Vehicle is returned less than 24 hours after the scheduled time: 10 euros per full hour of delay, payable to Good Motors agency.
  • The Vehicle is returned more than 24 hours after the scheduled time: a penalty of 200 euros payable to Good Motors agency, plus an additional penalty of 50 euros for each full day's delay, also payable to Good Motors agency. The Hirer is also liable for any additional day's rental, charged at the normal rental extension rate. Any fuel adjustments are also payable by the Renter. Please note that in accordance with the Insurance Conditions, the Hirer will not be covered by Good Motors agency insurance in the event of damage to the Vehicle. In the event of a delay of more than one day, Good Motors agency may file a theft complaint with the appropriate authorities.

The Tenant also agrees to indemnify Good Motors agency for :

    - 50 Euros if the Vehicle is abnormally dirty on the outside;

If the soiling requires the intervention of a professional (painting, stickers, etc.), the Tenant must pay the invoice drawn up by this professional.

9. Insurance coverage

The Good Motors agency Vehicle has been rented through the Good Motors agency website. Therefore, subject to compliance with the insurance conditions, the use of the Vehicle by the Renter is covered by the Mutuelle du motard insurance policy taken out by Good Motors agency. The insurance cover available to the Hirer and his obligations in the event of a claim are set out in the GCU.

If the insurance conditions are met, the Renter will automatically benefit from the insurance cover taken out by Good Motors agency with the Mutuelle des Motards within the limits of the operating conditions of this insurance.

If Good Motors agency or the lessee causes a lapse in insurance cover by failing to comply with the terms and conditions, it undertakes to personally assume all the consequences of any claim.

10. Use of Good Motors Agency assistance

In the event of breakdown or accident to the Vehicle, the Hirer may call on the services of the Good Motors agency.

The Hirer shall immediately inform Good Motors agency on the following number: 07.81.35.24.35.

Breakdown service 24 hours a day, 7 days a week. Coverage of costs up to €180, with the exception of spare parts, which remain the responsibility of the beneficiary.

11. Use of the Good Motors agency payment service

Good Motors agency and the Renter may use the payment service for any payments owed by one party to the other. Such payments may include, for example:

  • mileage-based settlements
  • compensation for differences in fuel levels
  • the compensation and penalties provided for in article 9 of the present clauses of the Rental Contract

12. Application of the Rental Contract

In the event of disagreement in the application of the Rental Contract, the Renter and Good Motors agency undertake to seek an amicable solution.

If conciliation fails, Good Motors agency and the Lessee may turn to the competent court.

WHAT TYPE OF INSURANCE IS IT?

Motorcycle / Scooter / Side /Trike / Quad insurance is designed primarily to cover the rider of a 2- or 3-wheeled vehicle against the consequences of material damage or bodily injury caused by his or her vehicle to third parties (civil liability). This insurance is compulsory. It also covers bodily injury to the driver and, depending on the terms and conditions of the insurance contract, may include optional supplementary cover, e.g. for material damage to the insured vehicle.

! Legal exclusions including damage :  

- Occur when the driver is underage or does not have a valid license,

- Occurring during events, races, competitions (or their trials) subject to authorization,

- Suffered by passengers when they are not transported in sufficiently safe conditions

! Intentional acts

! Civil or foreign war, riots

! Theft by family members

! Loss of earnings or depreciation of the vehicle following immobilization (breakdown, accident, etc.).

! In the event of drunk driving or driving under the influence of narcotics not prescribed by a doctor

! Damage due to lack of maintenance, wear and tear or inherent defect of the vehicle.

MAIN RESTRICTIONS :

! The insured may be required to pay a deductible, particularly for theft, fire and damage to the vehicle.

In the event of a claim

- Declare any claim likely to involve one of the warranties in accordance with the conditions and deadlines laid down, and enclose all documents required to assess the claim.

- Inform you of any cover you may have taken out for the same risks, in whole or in part, with other insurers, as well as any reimbursement you may receive in respect of a claim.

- In the event of theft, lodge a complaint with the appropriate authorities within 24 hours, and provide the original copy of the complaint.
